A Y chromosome test as a paternity test

Does the mother have to participate in the Y chromosome test?
No that is not necessary. It’s not even possible. Y chromosomes are only passed from father to son.
Can a biological link between father and son be established if the father does not participate in the test?
Yes, the Y chromosome test is extremely suitable for this. The Y chromosome test can then be performed on the child and a male blood relative of the alleged father (for example, a paternal uncle, cousin or grandfather). The result of this DNA test will then indicate whether there is a relationship between the two men. The result does not indicate which relationship that is. But once the relationship has been established, you can also draw your conclusions about paternity.
Are there other DNA tests that establish paternity without the father participating?
Yes, other so-called ‘indirect’ DNA tests are possible. Think, for example, of the various (half) brother-sister tests, the uncle-aunt test and the grandparent test.

What is a legally valid test?

Legally valid means that you can submit the result in a legal procedure or lawsuit. For example, about family reunification, custody, alimony or an inheritance. The reliability of a legally valid test is the same as with an informative (peace of mind) test. Only the collection of the DNA sample is different and must meet certain guarantees.
Can I also use the results of a peace of mind test in a lawsuit?
Although the result of a peace of mind test is just as reliable as the result of a legally valid paternity test, we are not aware of any cases where the result of a peace of mind test has been accepted in legal proceedings. That’s because of the way the DNA is taken. If the parties take the DNA themselves, without the presence of an independent third party, the court or government agency cannot simply assume that the samples submitted actually come from the right people. And that the monsters have not been tampered with. So if you want to be sure that you can use the results in a lawsuit, choose the “legally valid” option when ordering.
